Terms and Conditions of Installation

Cancellation

We may impose a cancellation and/or re-scheduling fee in the event of cancellation or a re-schedule before the date of reservation. The fee will depend on the nature of the reservation, the length of notice before the reservation, the reasonable potential to find an alternative Client for the reservation, and the reason for cancellation or re-schedule. No refunds on deposits in the event of cancellation or re-scheduled work for already ordered/made Special–Order Goods.  A fee of R 200.00 will be charged on all cancellations or re-schedules of appointments if we are already in the proximity of the client’s premises.

Warranty

Nano IS Western Cape (Pty) Ltd shall within six months after finalization replace failed, unsafe or defective goods installed during additional work relating to fibre installation including, but not limited to paving or refund the Client the price paid by the Client at the election of the Client.  The aforesaid warranty is subject thereto that the goods have not been altered contrary to any instruction of Nano IS Western Cape (Pty) Ltd after leaving Nano IS Western Cape (Pty) Ltd’s control, has not been exposed to abuse or exposed to use other than what the unit was manufactured for.  Any claim for defective goods must be submitted to Nano IS Western Cape (Pty) Ltd in writing including the original Tax Invoice. No return will be accepted unless Nano IS Western Cape (Pty) Ltd has been supplied with a reasonable opportunity to inspect the goods returned in order to determine the reasons for the defectiveness of the goods, if any.

Delivery

Notwithstanding anything to the contrary Nano IS Western Cape (Pty) Ltd’s’ obligation to meet the reservation for additional work relating to fibre installation shall in all cases be subject to the following:

Whilst delivery times are given in good faith and Nano IS Western Cape (Pty) Ltd will use every endeavour to comply therewith, no responsibility can be accepted for any loss or damage incurred by the Client on account of any delay in delivery arising out of any circumstances beyond Nano IS Western Cape (Pty) Ltd’s control, which circumstances will include, but in no way be limited to:

  1. Any delays in the supply of products to be installed during service delivery ’ Suppliers which cannot be directly or indirectly attributed to them;
  2. The Client/their employees’ instructions with regard to the specifications of the service to be provided are inaccurate. If the specifications supplied are incorrect/altered Nano IS Western Cape (Pty) Ltd reserves their right to change the amount quoted accordingly;
  3. If the Client/employees doesn’t provide Nano IS Western Cape (Pty) Ltd with the necessary access to their premises in order to determine the necessary specifications of the work to be undertaken;
  4. Any delays due to adverse weather conditions;
  5. If the balance of the price payable on the date of reservation is not paid on the date of anticipated delivery.

Nano IS Western Cape (Pty) Ltd will communicate the unavoidable delay in the delivery.

 

Indemnity

The Client acknowledges the risk involved in the supply of additional work relating to fibre installation including, but not limited to paving by Nano IS Western Cape (Pty) Ltd and hereby indemnify Nano IS Western Cape (Pty) Ltd against claims for harm/damage caused to him/his property due to reasons beyond the reasonable control or unintentional act of any person, whether or not in the employ of Nano IS Western Cape (Pty) Ltd. This will include loss or damage caused as a result of fire or theft, or any economic loss pertaining to the harm/damage caused.

 

Payment Terms

Nano IS Western Cape (Pty) Ltd reserves its right to suspend services in the event that payment for such orders are not made on time. In the circumstances where payment is outstanding for a period exceeding 30 days from date of statement and will Nano IS Western Cape (Pty) Ltd charge interest at a rate not exceeding 2% per month or as per the maximum rate determined by the National Credit Act from time to time on overdue payments.

All accounts older than 30 days will be handed over for collection and will the Client be liable to pay all legal fees with regard to the collection of such outstanding amounts on a fee scale as determined by the court of law/tribunal where the collection matter will be adjudicated.

The Client hereby agrees to the jurisdiction of the Magistrate Court of Cape Town in the event that any outstanding amount is handed over for collection, although such Magistrate Court may normally not have jurisdiction in the matter.
